We decided to appeal for this decision, as we think it is absolutely unfounded for the following reasons :

- The app is not downloading anything it isn’t supposed to – anything hidden or something – nor does it convert any video format. All it does is to simply “parse” the list of available videos by Youtube and point the user to them. It doesn’t circumvent any security features – the information is already there for anyone who can “view source” of that specific page and download the videos himself (perhaps with a bit of a technical… eye); all the tool does is to help someone do that easily.

- Youtube is held accountable for any videos uploaded to their site. If a video infringes someone’s copyright, then Youtube itself is responsible for removing it from the servers and making it unavailable for the public. In a few words, whichever video is “online” at the YouTube website has their approval for my watching it as a simple user on my computer. (and if you can’t “watch” a specific video – perhaps because it has been ‘removed’ – nor can you download it with our app)

- Youtube grants their users’ the right to “watch” their online videos on their computer. What difference does it make if the user also stores it on his hard disk? (given that, even if the user doesn’t know it, whenever he watches a video, most times the video is already “cached” – which means : stored somewhere in his hard-drive. Does this make Safari or Chrome illegal-to-use?) NOTE : if there is such an issue, or if it is adviseable as a means of solving this… riddle, we could add a warning or a notification somewhere in the app’s license, saying something along the lines : the videos retrieved using the application are for personal use only and that the user agrees to abide by the aforementioned terms…

- Even if YouTube (or a personal site of mine, for that matter) indicates that “I don’t want you to download file X” – this doesn’t automatically make my downloading that specific file an action against the law, unless their claim is based on some legal background/documents – which in this case it has only be occasionally almost like an “advice” or “term” with no legal substance.

- The app doesn’t enable sharing of videos, but just storing them on a chosen location in the local hard disk of the user (which, as already mentioned, is done by default by most browsers…)

- There are literally DOZENS of similar tools (either online, standalone, or browsers plugins) which do pretty much the very same thing (even some ultra-popular and old ones, e.g. for Firefox), that have never faced any allegations of being illegal.

I hope you will take our reasons into consideration and reach a fair… verdict. In any case, if any of our points is not clear enough, please let us know what we could do in order to clarify them further and/or set up a user license that will make them fully known to the users.
